TERMS OF USE OF THE ONLINE STORE
Visitors and users of the online store of SIA “Jaunā Vecrīga” https://jaunavecriga.lv/ (hereinafter – the “e-store”) agree and undertake to comply with the terms of use set out below.
The e-store is administered by SIA “Jaunā Vecrīga” (hereinafter – “JV”), legal address: Mežkalnu iela 20, Mārupe, Mārupes nov., LV-2167, Registration No. 50103633331, Phone: 29896138, e-mail: jaunavecriga@knutstyle.lv
1. Subject of the Agreement
1.1. JV sells trip tickets and gift cards (hereinafter – “tickets”) for vessels and other watercraft owned/operated by JV.
1.2. JV is entitled to set or change ticket prices and sales terms, determine seating arrangements, determine minimum or maximum capacity during trips, and set other parameters.
1.3. The rights and obligations related to tickets are determined and announced by JV, and JV assumes responsibility for the content or performance of such rights and obligations. JV is responsible for the content, quality, information, or advertising.
2. Prices and Payments
2.1. Ticket prices and the quantity of tickets available in the e-store at the relevant price may change until the moment the customer has placed the tickets in the shopping cart.
2.2. A ticket discount is available only for standard prices. Discounts cannot be combined with other discounts.
2.3. Tickets for one event/trip may simultaneously be offered for sale at different prices.
2.4. JV reserves the right to independently develop its ticket sales strategy without prior notice to visitors or ticket holders.
2.5. In accordance with JV’s strategy, special ticket offers or special prices may be available for sale; their conditions and validity periods are indicated separately in the description of each trip.
2.6. For payment of the tickets selected in the e-store, 15 minutes are granted during which the customer must complete the payment using internet banking or payment cards (VISA, Mastercard).
2.7. If the customer has not made the payment within 15 minutes, the transaction is deemed not to have taken place. The tickets are automatically released back for sale and the customer must repeat the purchasing process from the beginning.
2.8. Purchasing tickets in the online store https://jaunavecriga.lv/ is a paid service, and any delivery fee (if applicable for the selected delivery method) is added to the total purchase amount.
2.9. Ticket reservation is not possible in the e-store and payment for the selected tickets must be completed within 15 minutes after adding them to the shopping cart.
2.10. JV is entitled to cancel any purchase if there are suspicions of possible fraudulent nature of the transaction, the use of another person’s internet bank or payment card and/or payment card data, whereby the acquisition of goods and services is unlawful. The person guilty of such criminal transaction may be held liable in accordance with the Criminal Law of the Republic of Latvia.
3. Ticket Terms
3.1. The ticket may be used during the current season from the moment of purchase, but no later than until the end of the current year’s season.
3.2. If the ticket is not used by the last day of the ticket validity period (inclusive), it shall be deemed that the Buyer has waived the use of the ticket, and the Buyer loses the right to receive the service, except for the case specified in Clause 3.7.
3.3. If the ticket is for an event, concert, special trip, journey, etc. taking place on a specific date(s), the buyer must use the ticket no later than the relevant event, unless otherwise stated in the offer.
3.4. If the merchant was ready to provide the service referred to in Clause 3.3, but the buyer (legal entity or natural person) did not show up or refused to receive the service, JV is entitled not to refund the paid amount for the service.
3.5. A trip may be cancelled / the buyer may be refused a trip:
3.5.1. due to unsuitable weather conditions;
3.5.2. due to technical reasons;
3.5.3. if the vessel/boat has been reserved;
3.5.4. if the required number of passengers is not met / or if the trip has reached sufficient capacity;
3.5.5. in case of force majeure circumstances.
3.6. If the Buyer has purchased a ticket and, upon arriving at the relevant vessel berth, one of the circumstances specified in Clauses 3.5.2, 3.5.3, 3.5.4 is established, and if JV has the possibility to offer another trip on a vessel owned/operated by JV, the Buyer may use the ticket for the offered trip.
3.7. The Buyer has the right to receive a refund for the ticket purchase if any of the circumstances referred to in Clause 3.6 has occurred.
3.8. After the end of the ticket validity period, it is no longer possible to extend it.
3.9. Since the ticket validity period is the entire current season, JV does not make reservations, and the purchased ticket does not guarantee a seat on a specific departure/trip.
3.10. For the Riga Panorama Cruise, you must arrive at least 30 minutes before departure.
3.11. For the Sunset Cruise, you must arrive at least 50 minutes before departure.
3.12. For the Old Town Panorama Cruise, you must arrive at least 20 minutes before departure.
3.13. For the Jūrmala trip, you must arrive at least 30 minutes before departure.
3.14. For the Mežaparks trip, you must arrive at least 30 minutes before departure.
3.15. For other trips not listed separately above, you must arrive at least 25 minutes before departure.
3.16. Changes to the vessel trip schedule must be followed only on JV’s official website where tickets are sold. Changes are published as soon as JV has official information.
3.17. The ticket may be presented electronically unless otherwise stated in the offer.
3.18. JV is entitled to send essential information to the customer’s registered e-mail address related to the use of the service, for example, unforeseen changes in working hours, changes in berth location, or similar cases.
3.19. All complaints about the event/service content, quality, and advertising must be submitted to JV.
4. Delivery
4.1. E-tickets are sent to the customer’s indicated e-mail address automatically after payment for the order has been completed.
4.2. The sale of E-TICKETS is discontinued at the end of the season or earlier if determined by JV.
5. Seller’s Liability
5.1. One customer may purchase no more than 15 tickets for one trip in a single purchase, unless JV has determined otherwise.
5.2. JV does not verify the user’s identity. Without limiting the above, any and all visitors and users of JV’s e-store confirm JV as their personal data processor and agree that data may be collected, recorded, stored, arranged, transformed, used, transferred and distributed, blocked or deleted in accordance with the Personal Data Protection Law of the Republic of Latvia. The data controller and processor is SIA “Jaunā Vecrīga”, legal address: Mežkalnu iela 20, Mārupe, Mārupes nov., LV-2167, Registration No. 50103633331.
5.3. The personal data processed by JV under these Terms of Use are only the data submitted online by the visitor or user of JV’s e-store when providing data for ticket purchase in JV’s e-store. The sole and true purpose of personal data processing within these Terms of Use is to ensure the operation of JV’s e-store (website https://jaunavecriga.lv/). To achieve the above purposes, JV has the right to transfer personal data to companies belonging to the same group of companies within JV.
5.4. JV contact information is indicated at the beginning of these Terms of Use and is also available on https://jaunavecriga.lv/.
5.5. JV does not verify the identity of the ticket buyer or owner and does not assume liability for any losses that may arise as a result thereof.
5.6. Violation of the e-store Terms of Use entitles JV to block access and/or cancel any user’s ticket purchase.
5.7. JV is not responsible for articles, comments and other data posted on the website by the e-store user or website visitor.
5.8. JV’s website may contain reviews and links to information on the worldwide internet; since JV cannot control these sites and the information placed there, JV assumes no responsibility for compliance, relevance, and information on such sites.
5.9. Any use of this website (for ticket sales, advertising, business offers and other commercial activities), including references to JV, is prohibited without JV’s written permission.
6. Buyer’s Liability
6.1. The e-store user undertakes not to interfere with the operation of the e-store and its technological solutions.
6.2. Any monitoring, copying, reproduction, adaptation, use and publication of data of the e-store for any purpose is prohibited. Any activity that causes an unreasonably large download of information from the e-store or the ticket reservation system is prohibited.
6.3. By using the e-store, the user agrees:
6.3.1. that they are at least 18 years of age and a fully responsible person (for persons aged 7–18 with limited legal capacity, approval of a fully responsible person is required that they are granted the right to use the e-store);
6.3.2. to comply with all e-store Terms of Use;
6.3.3. to assume full responsibility to ensure that their username or password does not become known to third parties;
6.3.4. not to use a third person’s payment card to pay for tickets;
6.3.5. to comply with the ticket usage terms indicated on each ticket.
6.4. Violation of these Terms of Use entitles JV to block access and/or cancel any user’s ticket purchase.
Any disputes that may arise when shopping in the e-store shall be resolved in accordance with the laws in force in the territory of the Republic of Latvia.
